1. Acceptance of Terms
By creating an account or using SidePilot, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and agree to comply with these Terms of Service, our Privacy Policy, and our Refund Policy.
2. Description of Service
SidePilot is a web-based platform providing realtime streaming tools including overlay management, collaborative canvas, chatbot automation, and moderation features. The service is offered on a subscription basis with different plan tiers.
3. Accounts and Authentication
You must authenticate via a supported OAuth provider (Twitch, Kick). You are responsible for maintaining the security of your account and all activities that occur under it. You must not share your access tokens or allow unauthorized persons to use your account.
4. Subscriptions and Billing
- SidePilot offers paid subscription plans with different feature sets and limits.
- Subscriptions are billed according to the selected billing period (monthly or yearly). Prices are displayed at the time of purchase.
- Subscriptions with auto-renewal enabled will automatically renew at the end of each billing period unless canceled before the renewal date.
- Displayed prices may not include applicable taxes. You are responsible for any taxes imposed on your subscription.
- We reserve the right to modify subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect on their next renewal.
5. Acceptable Use
You agree to use SidePilot only for lawful purposes. You must not:
- attempt unauthorized access to the service, other accounts, or systems connected to SidePilot;
- interfere with or disrupt the service, servers, or networks;
- reverse engineer, decompile, or disassemble any part of the service;
- use the service to distribute malware, spam, or harmful content;
- violate the terms of service of connected streaming platforms (Twitch, Kick);
- impersonate any person or entity or misrepresent your affiliation;
- use the service for any activity that violates applicable laws or regulations.
6. Intellectual Property
All rights, title, and interest in SidePilot — including software, design, logos, and documentation — belong to the service operators. Your subscription grants you a limited, non-exclusive, non-transferable license to use the service for its intended purpose. You retain ownership of content you create using the service (overlays, canvas configurations, chatbot setups).
7. Termination and Suspension
We may suspend or terminate your access to SidePilot at our discretion if you violate these Terms, engage in abusive behavior, or if continued access poses a risk to service stability or security. You may close your account at any time. Upon termination, your right to use the service ceases immediately. Provisions regarding intellectual property, limitations of liability, and dispute resolution survive termination.
8. Disclaimer of Warranties
SidePilot is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not warrant that the service will be uninterrupted, error-free, secure, or meet your specific requirements. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SidePilot and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the service. Our total aggregate liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless SidePilot and its operators from any claims, damages, losses, costs (including reasonable attorney's fees) arising from your use of the service, violation of these Terms, or infringement of any third party's rights.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through the website or by email. Your continued use of SidePilot after such changes constitutes acceptance of the updated terms. If you disagree with the changes, you must stop using the service and close your account.
12. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws applicable to the jurisdiction of the service operator. Any disputes arising from these terms or your use of the service shall be resolved through good-faith negotiation first. If no resolution is reached, disputes shall be submitted to the competent courts of the service operator's jurisdiction.
